FAKE CALL
These Terms of Service (the "Terms") set out the conditions for using Fake Call (the "App"), provided by the developer of the App ("we" or "us"). By downloading, installing, or using the App, you are deemed to have agreed to these Terms.
The App reproduces an incoming phone call so that you have a natural excuse to step away. It does not make or receive any real phone or voice calls. Using the App to deceive others and harm their property, body, or reputation, or to impersonate public authorities or emergency services, is strictly prohibited.
1. Scope
These Terms apply to everyone who uses the App.
2. No registration
You do not need to register with us to use the App. The App neither obtains nor manages any account information.
3. Pricing and Premium
The App's basic features are free to use.
Some features become available by purchasing a one-time in-app purchase ("Premium"). The price is the amount shown in the store at the time of purchase and varies by the country or region in which you use the store.
Premium purchases and payments are handled through the App Store (Apple Inc.) or Google Play (Google LLC) and are subject to that store's terms and conditions. Please send refund requests directly to the store, in accordance with its terms.
You can enable Premium again by using "Restore purchase" in the App while signed in with the same Apple ID or Google account you used for the purchase.
4. License
Subject to your compliance with these Terms, we grant you a non-transferable, non-exclusive right to use the App for your own personal, private purposes.
5. Your responsibility
You use the App at your own risk and are responsible for everything you do with it and for the results. You must comply with the laws of the country, region, and place in which you use the App.
6. Prohibited conduct
When using the App, you must not engage in any of the following, or in anything likely to amount to it.
- Anything that violates laws, court judgments, decisions, or orders, or public order and morals
- Impersonating public authorities (police, fire, ambulance, coast guard, military, courts, tax offices, and the like) or emergency services
- Impersonating any real individual, company, organization, government body, or public institution
- Fraud, extortion, threats, harassment, stalking, impersonation, false reports, or any other crime, or preparation for one
- Deceiving others in a way that causes them financial, physical, or emotional harm
- Using the App as a business or for profit beyond personal, private use
- Reverse engineering, decompiling, disassembling, modifying, redistributing, or reselling the App, or similar acts (except to the extent expressly permitted by law)
- Interfering with the App's operation or compromising its security
- Infringing the rights or interests of us, other users, or any third party
7. Call screen designs and third-party trademarks
The App provides incoming call screens inspired by the look of messenger and video calling apps. These are generic representations for recreating usage scenes. They do not use, or claim any rights to, the trademarks, logos, brand names, or designs of any particular third party, and they do not indicate any affiliation with, sponsorship by, or endorsement from any such third party.
8. Intellectual property
All intellectual property rights in the App, including its text, images, audio, design, and software, belong to us or to their rightful owners. Except as expressly licensed in these Terms, no rights are transferred to you.
Rights to the icon images, background images, ringtones, audio files, and other content you add to the App belong to their respective owners. You may add only content that you are entitled to use.
9. Provision, changes, and discontinuation
We do not guarantee that the App is complete, accurate, useful, or fit for any particular purpose, or that it is free of errors or defects. Depending on the OS version, device model, store status, or other factors, some or all of the App may not work properly.
We may change, suspend, or discontinue the App without prior notice to you.
10. Disclaimers
- Calls in the App are reproduced on your device and are not real calls from a telecommunications carrier. We are not responsible for any consequences arising from you or anyone else mistaking a call in the App for a real call.
- We are not responsible for damage you cause to third parties by using the App, or for disputes between you and third parties.
- For damage you suffer from using, or being unable to use, the App, where the damage results from our slight negligence (negligence that is neither willful nor gross), our liability is limited to ordinary, direct, and actual damage, up to the amount you paid for Premium.
- The limit in the preceding item does not apply where we have acted willfully or with gross negligence.
11. Privacy
Information in the App is handled in accordance with our separate Privacy Policy.
12. Relationship with store terms
The App is distributed through the App Store and Google Play. In addition to these Terms, the terms of the store you use apply to obtaining, updating, purchasing, and refunding the App. Where these Terms conflict with a store's terms, the store's terms prevail to the extent of that conflict.
13. Changes to these Terms
We may change these Terms as necessary. The changed Terms take effect when posted on this page, and the "last updated" date will be revised. Significant changes will also be noted in the App's release notes.
14. Severability
If any provision of these Terms is held invalid or unenforceable under applicable law, the remaining provisions remain in full effect.
15. Governing law and jurisdiction
These Terms are governed by the laws of Japan. The Tokyo District Court shall have exclusive jurisdiction as the court of first instance over any dispute between us and you arising from these Terms or the App.
